1. Acceptance of Terms

By accessing or using the services provided by ClickIt ("we," "us," or "our") at our location in 1st Floor, Eternity Mall, Variety Square, Nagpur, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use our services.

2. Service Description

ClickIt operates a professional photo booth service offering:

  • Individual, group, and couple photography sessions
  • Instant photo prints
  • Digital copies of photographs
  • Custom backgrounds and props
  • Event photography packages

All services are subject to availability and may be modified or discontinued at our discretion.

3. User Eligibility

Our services are available to:

  • Individuals aged 18 years and above
  • Minors accompanied by a parent or legal guardian
  • Groups and corporate entities for event bookings

Parents or guardians are responsible for minors using our services and must provide consent for photography.

4. Booking and Payment

4.1 Booking Process

Walk-in customers are welcome during business hours (10:00 AM - 10:00 PM, All Days). For special events or extended sessions, advance booking is recommended.

4.2 Payment Terms

  • Payment must be made before or immediately after the photo session
  • We accept payments through Razorpay (UPI, credit/debit cards, net banking, wallets)
  • All prices are in Indian Rupees (INR) and include applicable taxes
  • Prices are subject to change without prior notice
  • Payment receipts will be provided via email or SMS

4.3 Failed Transactions

In case of payment failure or technical issues, please contact us immediately. Refunds for failed transactions will be processed within 5-7 business days.

5. Service Delivery

5.1 Photo Prints

  • Instant prints are provided immediately after the session
  • Print quality may vary based on technical conditions
  • Reprints may be available for an additional fee (subject to availability)

5.2 Digital Copies

  • Digital copies are delivered via email or QR code scan
  • Digital files are provided in standard resolution suitable for personal use
  • Digital copies remain accessible for 90 days from the date of service
  • After 90 days, we are not obligated to maintain your photographs

6. User Conduct and Responsibilities

When using our services, you agree to:

  • Treat our staff, equipment, and premises with respect
  • Follow all safety guidelines and instructions provided by our staff
  • Not engage in any illegal, offensive, or inappropriate behavior
  • Not damage or misuse our equipment, props, or facilities
  • Supervise minors in your group at all times
  • Not bring outside food, drinks, or hazardous materials into the photo booth area

We reserve the right to refuse service or terminate a session if these guidelines are violated.

7. Intellectual Property Rights

7.1 Customer Photographs

  • You retain ownership of photographs taken during your session
  • You grant us a non-exclusive license to use photographs for promotional purposes (with your consent)
  • You may opt out of promotional use by informing us in writing

7.2 Company Property

  • All logos, branding, backgrounds, and templates are our intellectual property
  • You may not reproduce, distribute, or commercially exploit our proprietary materials

8. Cancellation and Refund Policy

9. Liability and Disclaimers

9.1 Service Quality

While we strive to provide high-quality services, we do not guarantee:

  • Perfect photographs in all lighting or environmental conditions
  • Availability of specific props or backgrounds at all times
  • Uninterrupted service due to technical or operational issues

9.2 Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid for the specific service
  • We are not responsible for loss or damage to personal belongings
  • We are not liable for injuries resulting from customer negligence or misconduct

9.3 Technical Issues

We are not liable for service interruptions due to equipment failure, power outages, internet connectivity issues, or circumstances beyond our control. In such cases, we will make reasonable efforts to reschedule or provide alternative solutions.

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information and photographs.

11. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or public health emergencies
  • Government orders or restrictions
  • Mall closures or operational restrictions
  • Acts of terrorism or civil unrest

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after such modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra.

14. Dispute Resolution

In the event of any dispute:

  1. Contact us first to resolve the issue amicably
  2. If unresolved, both parties agree to attempt mediation before pursuing legal action
  3. Legal proceedings, if necessary, shall be initiated in Nagpur courts

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and ClickIt regarding the use of our services.
